These terms set out the rules for using The Learning Network website, memberships, courses, events and resources. By accessing our website or purchasing from us, you agree to these terms. Please read them carefully.
About us
The Learning Network is an education business founded by Kelly Bell, based in New South Wales, Australia. We provide done-for-you resources and professional learning for teachers of Primary PE, PDHPE, CAFS and HMS. In these terms, "we", "us" and "our" refer to The Learning Network, and "you" refers to the person or school using our services.
Memberships and purchases
When you join a membership or buy a course, resource or event ticket, you are entering an agreement with us on these terms. We will provide access to the relevant content once your payment is received. Some memberships are recurring subscriptions that renew automatically until cancelled.
Your account
To access memberships, courses and resources you may need to create an account. You are responsible for keeping your login details secure and for all activity that happens under your account. Do not share your login or membership access with others. Please let us know promptly if you believe your account has been used without your permission.
Pricing and payment
Prices are shown in Australian dollars and may change from time to time. Payment is processed securely through our payment providers at the time of purchase. For recurring memberships, you authorise us to charge the applicable fee each billing period until you cancel. It is your responsibility to keep your payment details up to date.
Your licence to use our resources
Our resources are created for use by an teacher at the school that they are employed. When you purchase or access a resource, we grant you a personal, non-transferable licence to use it for your own teaching. Unless we agree otherwise in writing, you may not:
- Share, sell, distribute or upload our resources to any public or shared platform.
- Share your login or membership access with others.
- Reproduce our resources for use across a whole faculty or school without an appropriate school or multi-teacher licence.
- If your school has purchased a membership, use the resources with students you personally tutor or mentor, or with other educational organisations such as study and revision days.
If you need access for a faculty or whole school, please contact us about a school membership.
Intellectual property
All content we provide including resources, programs, videos, images, branding and written material is owned by The Learning Network or its licensors and is protected by copyright. Your licence to use it does not transfer any ownership to you.
Cancellations and refunds
You can cancel a recurring membership at any time, and it will not renew for the next billing period. Because our resources are digital and available immediately, purchases are generally non-refundable except where required by the Australian Consumer Law. If something is not right, contact us and we will do our best to help.
PL events
From time to time we run in-person and online professional learning (PL) events. When you book a ticket, the following applies unless we state otherwise on the event page:
- Transfers: if you cannot attend, you may transfer your ticket to another teacher by letting us know 72 hours before the event.
- Cancellations by you: tickets are generally non-refundable, but contact us as early as possible and we will do our best to help, in line with the Australian Consumer Law.
- Postponed or cancelled events: if we need to postpone an event, your ticket will be valid for the rescheduled date. If we cancel an event outright and cannot offer a suitable alternative, we will provide a refund for that ticket.
Acceptable use
When using our website and community spaces, you agree to act respectfully and lawfully. You must not misuse our services, attempt to gain unauthorised access, or post content that is unlawful, harmful or infringes the rights of others. We may suspend or end access for anyone who breaches these terms.
Educational content
Our resources are designed to support busy teachers and reflect our experience and understanding of the relevant syllabuses. They are a teaching aid, not a substitute for your own professional judgement. You remain responsible for how you use our resources in your context, and for meeting your own school and NSW Education Standards Authority (NESA) requirements.
Third-party links
Our website and resources may contain links to third-party websites or services that we do not control. We provide these links for convenience only and are not responsible for the content, accuracy or practices of those external sites. Accessing them is at your own risk.
Disclaimers and liability
We provide our website and resources with care, but to the extent permitted by law we do not guarantee they will be error-free or uninterrupted. Nothing in these terms excludes rights you have under the Australian Consumer Law. Where we are permitted to limit our liability, our total liability to you is limited to the amount you paid us for the relevant product.
Privacy
We handle your personal information in line with our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. The "last updated" date at the top shows when they were last changed. By continuing to use our services after a change, you accept the updated terms.
Severability
If any part of these terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining terms will continue in full force and effect.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state.
